2. Side Kicks User Engagement and Responsibilities
2.1 Account Creation and Management: By registering an account on Side Kicks, sellers agree to provide accurate personal and financial information, including name, contact details, billing address, payout preferences and banking details. Additional identification, such as a driving license or passport, may be required. Sellers are responsible for the security of their account information. Buyers have the option to register an account for enhanced shopping experience or may opt to purchase as guests, in which case they are still bound by Side Kicks’ Terms. Misrepresentation or failure to maintain account security may result in account suspension or termination.
2.2 Maintaining Account Security: If you suspect or become aware of any unauthorized use of your password or account, you must immediately notify Side Kicks. Failure to maintain the confidentiality of your account details may result in you being held liable for any losses incurred by Side Kicks or any third party due to unauthorized account use. Under no circumstances should you use another user's account or password without the explicit permission and consent of the account holder. This policy is critical for maintaining the integrity and security of the Side Kicks platform.

3. Platform Mechanics
3.1 Overview of the Online Platform Functionality: Side Kicks serves as a dynamic platform where independent third-party sellers can list and sell their products across various mediums, including online, mobile applications, and physical stores. In this arrangement, Side Kicks acts solely as a facilitator (agent) , providing the necessary infrastructure for transactions without assuming the role of buyer or seller. The contractual relationship for any purchase is established directly between the buyer and the seller. Our involvement is confined to the capacity of a commercial intermediary, streamlining the sales process, with the understanding that prices, set by the sellers, may vary and can sometimes be higher than typical retail values.
3.2 Second Hand Items: All items available on the Side Kicks platform are classified as second-hand. Despite this classification, our strict quality policy mandates that these items must be in an unused state, adhering to the following criteria:

4.1 Financial Commitments, Buyer Fees and Taxes: When engaging in a purchase through the Sidekicks Platform, the following payment terms apply:
Buyers on Side Kicks agree to take full responsibility for all local, import, or sales taxes (including VAT) that may be applicable to their purchase transactions. It is understood and agreed that Side Kicks is not obligated to report, collect, or remit any such taxes on behalf of the buyer.

4.3 Managing Counterfeit and Non-Delivery Issues
Non-Delivery Reporting:
If a buyer has not received their item by the indicated delivery date, they must inform Side Kicks within 2 days following the latest indicated delivery date.
Failure to report within this 2-day window absolves Side Kicks of responsibility for the undelivered item. In such cases, we recommend contacting the carrier directly for further assistance.
Non-Delivery of Item:
If an item is marked as delivered but not received, first contact the carrier for parcel location.
If the carrier cannot resolve the issue, inform Side Kicks immediately. We will guide you through the next steps, which may include initiating an investigation with the parcel carrier.
Reporting Suspected Counterfeits (Fake Items):
In cases where an item received is suspected to be counterfeit, the buyer must notify Side Kicks in writing within 14 business days of receipt.
Side Kicks may request buyer cooperation in the investigation, which could include providing photographs or other evidence, and returning the item for further inspection.
Outcome of Counterfeit (Fake Item) Investigation:
Item Confirmed as Fake: Upon verification of the item's counterfeit status, Side Kicks will process a full refund.
Item Verified as Authentic: If the item is authenticated, the buyer is responsible for all associated return costs, including the cost of sending the item back after authentication.
Non-Payment of Return Fee: If a buyer refuses to pay the return fee for an item deemed genuine, Side Kicks reserves the right to repossess the item, and no refund will be issued.
4.4 Buyer’s Rights and Responsibilities
Right to Change Mind: You are entitled to change your mind and return an item for a refund as per applicable law. This right is valid only if the item remains unused.
Damaged Packaging: If you receive an item with damaged packaging, promptly send photographic evidence to help@sidekicks.co.uk. This step is crucial, especially if you decide to return the item later, as failure to report packaging damage might affect the full refund eligibility.
Product Display Variance: Be aware that the actual product may slightly differ from its photograph on the website. Variations can be due to lighting during photography or differences in device displays, affecting color perception. Other minor differences between the displayed and actual product may also occur.
5. Operational Policies
5.1 Preventing Fraudulent Activities: We have a strict zero-tolerance stance towards any forms of counterfeiting, fraud, and market manipulation. In cases where such activities are suspected, Side Kicks reserves the right to implement one or more of the following measures at our sole discretion:

Administrative Fees: A minimum fee of £7.5 or up to 85% of the transaction value may be imposed as an administrative charge.

6. Refund and Return Policies
This Returns and; Refunds Policy (“Policy”) applies to purchases made via sidekicks.co.uk and our points-of-sale worldwide. By initiating a return you agree to this Policy. Your statutory rights (where applicable) remain unaffected.
Definitions
• “Pre-Authenticated (In-Stock)” – goods already in Side Kicks’ possession that have been authenticated prior to listing.
• “Marketplace Dispatch (On-Demand)” – goods sourced from a partnered supplier following your order and routed through Side Kicks for verification prior to release. (Together with Pre-Authenticated items, the “Goods”.)
• “Working Day” – Monday–Friday, excluding public holidays at the return address.
• “RA” – Return Authorisation issued by Side Kicks via your account or email confirming conditional acceptance; final approval follows inspection and re-authentication on receipt.
Eligibility & Condition Requirements
• You must request a return within 14 days from the date the carrier marks your order as delivered (“Cooling-Off Window”).
• Goods must be unused, unworn and returned in the same condition supplied, with all original packaging and accessories. The Side Kicks security/NFC tag must remain fully attached and untampered.
• Evidence of wear/handling (e.g., creasing, outsole wear, odour, soiling, missing accessories/packaging) may render the return ineligible or lead to a valuation reduction (see §6).
• All returns are null and void if the Side Kicks security tag is removed, broken, detached, or re-attached. Do not remove the tag until you decide to keep the item. Tagged condition is required for eligibility and verification.
• Clothing items purchased by customers in the United States or Canada are final sale and may not be returned except where the Goods are defective, materially misdescribed, or not authentic in accordance with §7.
•Vintage items that are more than five (5) years old may only be returned for Side Kicks store credit where a return is approved under this Policy.
• All collectible sales are final and non-returnable due to the nature of sealed packaging, authenticity requirements, and the inability to verify items once opened or handled after delivery. This does not affect your rights in relation to Goods that are defective, materially misdescribed, or not authentic under §7.
How to Request a Return
• Visit account.sidekicks.co.uk, open the applicable order and submit a return request within the Cooling-Off Window. If eligible, you’ll receive an RA and instructions.
Ship-Back Deadlines; Packaging
• Once RA is issued, you must hand the parcel to the carrier (dropped off or collected) within 3 Working Days from the RA date. Labels created but not tendered within this period may be voided and the RA cancelled.• Use protective outer packaging; do not ship shoeboxes unprotected. You must retain a trackable proof of postage. Title and risk remain with you until Side Kicks confirms receipt at our designated hub.• Holiday returns: Orders placed 1 Nov–31 Dec may be returned until 15 Jan (standard conditions apply: item unworn/unused with SK tag attached; UK and international customers are responsible for arranging and paying for return shipping; Marketplace Dispatch admin adjustment may apply; defective/misdescribed items excluded from deductions). The 3-working-day drop-off/pickup rule after RA still applies, and international returns must arrive within 14 working days of RA.
Return Shipping & Labels
• United Kingdom: Customers are responsible for arranging and paying for return shipping. Returned items must be handed to the carrier within 3 Working Days from the date the Return Authorisation (RA) is issued. You must retain a valid trackable proof of postage until the return has been fully processed.
• Outside the United Kingdom: Customers are responsible for arranging and paying for return shipping and for all customs duties, taxes, brokerage/handling fees and any other import/export charges, as well as accurate customs declarations. Parcels should be marked “Returned Merchandise – no commercial value.” If any such charges are billed to Side Kicks, they may be deducted per §6. International returns must arrive at our designated return hub within 14 Working Days of RA issuance.
Inspection, Re-Authentication & Outcomes
• All returns undergo condition inspection and re-authentication upon arrival. Processing typically occurs within 0–3 Working Days of receipt.
• Approved: If the Goods pass inspection, we issue the applicable refund or Side Kicks store credit in accordance with this Policy, less applicable adjustments (see §6).
• Not Approved: If condition criteria are not met (e.g., wear, damaged/missing tag, missing components), we will notify you. You may choose return-to-sender at your cost within 14 days of notification. Where carriage is unpaid or we cannot reach you, we may hold the item for 30 days and then dispose of or donate it in accordance with local law.
Adjustments; Deductions (where permitted by law)
• Carriage; handling: Customers are responsible for all return shipping costs and any import/tax/brokerage charges billed to Side Kicks for the return may be deducted where permitted by law.
• Valuation adjustment: Where handling exceeds what is necessary to establish the nature/characteristics/functioning of the Goods, a reasonable reduction may be applied to reflect diminished value.
• Marketplace Dispatch (On-Demand) administrative restocking adjustment: For Marketplace Dispatch items only, Side Kicks may apply an administrative restocking adjustment of up to ten percent (10%) of the item price to reflect reverse-logistics and third-party supplier charges associated with re-intake. This adjustment does not apply to Pre-Authenticated (In-Stock) items and is not taken where §7 applies.
• Non-recoverable charges: Currency conversion differences and payment-provider fees/timing are outside our control and are not refundable unless required by law.
Defects, Misdescriptions & Counterfeits
• If you believe the Goods are defective, materially misdescribed or not authentic, contact us promptly with supporting evidence.
• Once verified, we’ll issue an RA. All deductions under §6 (including any administrative restocking adjustment) are waived. You will receive a full refund or store credit for the Goods in accordance with this Policy and applicable law.
• Goods determined to be counterfeit will not be returned to you. You will receive a full refund and we may cooperate with rights holders as required.
Exchanges
• We do not offer exchanges. Please place a new order. Approved returns are refunded or credited per this Policy.
Refund Method; Timing
• Approved refunds are issued either to the original payment method or as Side Kicks store credit, depending on the country, product category, and eligibility rules outlined in this Policy.
• For approved returns from customers in the United States and Canada, refunds are issued exclusively as Side Kicks store credit.
• Vintage items more than five (5) years old are eligible for Side Kicks store credit only where a return is approved.
• Once processed by Side Kicks, card/bank processors typically take 1–5 Working Days to post funds where applicable; timing depends on your payment provider. We cannot expedite third-party processing.
Country-Specific Provisions
• United Kingdom: Your statutory rights under the Consumer Rights Act 2015 and Consumer Contracts Regulations 2013 remain unaffected. Where these laws require refunds without certain deductions, those requirements prevail.
• EU/EEA: Where local consumer law grants a right of withdrawal, Side Kicks will honour those rights in accordance with the applicable member-state rules.
• United States & Canada: All sales are final unless the Goods are defective, materially misdescribed, or not authentic in accordance with §7. Where a return is approved, refunds are issued exclusively as Side Kicks store credit. Clothing items purchased by customers in the United States or Canada are final sale and may not be returned except where the Goods are defective, materially misdescribed, or not authentic.
• Rest of World: Returns are accepted under this Policy unless local mandatory law provides otherwise.
In-Store Purchases & Returns
• Eligibility: Only items purchased in a Side Kicks retail store can be returned in-store within 14 days of purchase. Online orders must follow the online RA process and cannot be returned in-store.
• Condition: Items must be unworn/unused and in the same condition supplied, with all original packaging and accessories; the Side Kicks security/NFC tag must remain fully attached. Proof of purchase (receipt/e-receipt or the original card used) is required.
• Options: In-store returns may be exchanged or issued as store credit (gift card). Any price difference is settled in GBP or store credit.
• Refunds: Refunds to the original payment method are not offered for in-store returns, except where required by law. Defective or misdescribed goods are handled under §7 (deductions waived; refund or store credit issued as required by applicable law).
• Notes: In-store purchases are Pre-Authenticated (In-Stock) and are not subject to the administrative restocking adjustment in §6.3. Do not mail returns to store locations; mailed returns must go to the return hub shown on your RA. For help, email help@sidekicks.co.uk.

7. Our Liability, Legal Limitations and General Terms

7.2 Accountability for Foreseeable Damages: We are liable for any foreseeable loss or damage that arises due to our breach of these Terms or our lack of reasonable care and skill. Foreseeable loss or damage is defined as such if it was apparent it would occur or if both parties were aware it might happen at the time the contract was made.
7.3 Exceptions to Liability Limitation: We do not limit our liability in any way that would be illegal. This includes responsibility for causing death or personal injury through our negligence, or that of our employees, agents, or subcontractors; for engaging in fraud or fraudulent misrepresentation; and for violating your legal rights related to items (including rights to items that are as described, of satisfactory quality, fit for a specified purpose, and provided with reasonable skill and care). We also remain liable for defective items under consumer protection laws relevant to the buyer’s location.
7.4 Accuracy and Errors on the Platform: Please be aware that the content on the Side Kicks Website and Marketplace, including but not limited to text and technical aspects, may occasionally contain errors or inaccuracies. Side Kicks does not assume responsibility for any losses related to such discrepancies. Furthermore, there is no commitment on our part to proactively rectify or notify users about these errors. Users are advised to use discretion and acknowledge that some information may not be entirely precise.
7.5 Links to External Websites: The Side Kicks Website and Platform may include links to external, third-party websites ("Linked Websites"). These links are provided for convenience and do not imply endorsement by Side Kicks. Responsibility for the availability, accuracy, and content of these Linked Websites lies solely with the respective third-party operators. Side Kicks explicitly disclaims any responsibility for the Linked Websites, including their content, accuracy, and availability, as well as for any interactions or engagements resulting from their use.
7.6 Third-Party Materials on the Platform: The Platform may feature content or materials provided by third parties ("Third-Party Materials").
